Rights, obligations and liability limits for the use of our construction and architecture platform.
These terms govern the use of the platform for construction projects, architecture and craft solutions operated by TopSide Constructions GmbH. The platform serves to provide information on construction services, project planning and the mediation of specialist companies. A contract for specific construction services is only concluded through a separate written agreement.
You are obliged to provide all information you submit – particularly regarding construction projects, locations and technical specifications – completely and truthfully. The use of the platform for unlawful purposes, such as promoting building violations or disseminating misleading offers, is prohibited. We reserve the right to block access in the event of violations.
We provide the platform with reasonable availability, but assume no liability for outages due to maintenance work, technical faults or force majeure. The planning and calculation tools provided serve as a guide and do not replace professional review by a structural engineer or architect. Specific construction project dates and cost estimates must always be confirmed by a specialist planner.
We are liable without limitation only for intent, gross negligence and for injury to life, limb or health. For simple negligence, we are liable only for breach of essential contractual obligations (cardinal obligations), limited in amount to the typical, foreseeable damage. Liability for indirect damages, lost profits or data loss is excluded to the extent permitted by law.
All content published on the platform – in particular construction plans, visualizations, texts and software – is protected by copyright. Reproduction, distribution or public making available requires our prior written consent. Users guarantee that content uploaded by them does not infringe the rights of third parties.
We reserve the right to change these terms at any time with four weeks' notice. Changes will be communicated to you by email or via a notice on the platform. In the event of objection or violation of the terms, we may terminate use without notice. Your stored data will be deleted after termination in accordance with our privacy policy.
The laws of the Republic of Austria apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from the use of this platform is the competent court in Vienna. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
